The court examining Ukraine's case against the Russian Federation in accordance with the UN Convention on the Law of the Sea has issued a procedural order stating that the International Tribunal for the Law of the Sea will first make decision on certain objections to jurisdiction, expressed by the Russian Federation.
The corresponding statement was made by the Ministry of Foreign Affairs of Ukraine concerning the jurisdictional stage of proceedings in the case concerning the rights of the coastal state in the Black Sea and the Sea of Azov and in the Kerch Strait (Ukraine against the Russian Federation).
“On August 31, 2018, the Tribunal, considering Ukraine's case against the Russian Federation in accordance with the 1982 United Nations Convention on the Law of the Sea, issued a procedural order stating that the Tribunal would first give a decision on certain objections to jurisdiction expressed by the Russian Federation,” the message says.
Diplomats recalled that on February 19, 2018 Ukraine submitted its Memorandum to the Tribunal, which proves that Russia violated Ukraine's sovereign rights in the Black and Azov Seas, as well as in the Kerch Strait.
“The Ukrainian Memorandum has shown that since 2014 Russia had illegally ousted Ukraine from the realization of its rights of the coastal state; used and continues to use the sovereign resources of Ukraine for its own purposes; and usurped the right of Ukraine to regulate its own coastal areas. In violation of international law, Russia, among other things, steals Ukrainian energy and fish resources, causes losses to Ukrainian fishermen and blocks traffic to Ukrainian ports,” reads the message.
Ukraine does not consider that the jurisdictional objections of the Russian Federation are substantiated or will be adopted by the International Tribunal for the Law of the Sea.
Earlier Deputy Minister of Foreign Affairs of Ukraine Olena Zerkal said that Kyiv is not going to break the agreement on cooperation with the Russian Federation in the Sea of Azov.
The Foreign Ministry noted that Ukraine will continue to use all available instruments for resolving the issue.
