Amendments to art. 282 of the Criminal Code of the Russian Federation "Incitement of hatred or hostility, as well as the humiliation of human dignity" will not reduce the number of cases "for repost" in the occupied Crimea, but only make the procedure for bringing to criminal responsibility longer.


Such an opinion was expressed by the coordinator of the Crimean Human Rights Group Olga Skrypnyk in the commentary to QHA.

“Article 282 of the Criminal Code refers to the so-called extremist package and is very actively used, especially in the Crimea. Russian parliamentarians call the proposed amendments to the article the decriminalization of extremist statements. But in fact, criminalization remains. The only thing that the procedure itself will become longer. First, a person can receive administrative punishment, and in case of no recurrences, criminal liability does not occur. But in the Crimea there are many examples where people have repeatedly been held accountable for the same post on the social networks VKontakte and Facebook. It turns out that a person can receive administrative punishment on one social network, and criminal punishment on another for the same post.”

According to the human rights defender, article 282 of the Criminal Code of the Russian Federation needs to be amended not only in terms of punishment, but also in parts of the plot.

“The article itself does not have a clear legal certainty, so it can be applied according to the subjective vision of the FSB, the Center “E” of the Ministry of Internal Affairs with the aim of persecuting people for expressing their views. Amendments to the article will not make life easier for residents of the Crimea.”

Olga Skrypnyk noted that Article 282 of the Criminal Code of the Russian Federation often becomes a pretext for searches, as a result of which cases are being instigated under more serious articles.

“Administrative cases are also actively used for prosecution, ranging from fines to administrative arrests. In addition to prosecution, article 282 is often used to conduct searches, for example, in order to search for prohibited religious literature, after which more serious criminal cases are initiated.”

Reference: October 3, the State Duma of the Russian Federation received a presidential bill on amending Article 282 (incitement to hatred or hostility, as well as humiliation of human dignity) of the Russian Criminal Code, under which sentences determined for repost in social networks. According to the draft law, criminal liability “for repost” can come only if a person repeatedly violates the law within a year.
